The Quezon City prosecutor’s office has dismissed perjury charges filed by Sen. Jinggoy Estrada against former DPWH district engineer Brice Hernandez for lack of sufficient evidence.
Estrada had accused Hernandez of falsely claiming that the senator earned millions in kickbacks from flood control projects, submitting his SALN to disprove the allegations.
The prosecutor ruled that perjury requires a “willful and deliberate assertion of falsehood,” which Estrada failed to prove against Hernandez.
Hernandez maintained that his statements were based on his personal knowledge and involvement in DPWH operations, meaning he believed them to be true.
While the prosecutor noted the statements may have been inaccurate or reckless, there was no conclusive evidence showing Hernandez acted with malicious intent, leading to the dismissal of the charges.
