The camp of Sen. Jinggoy Estrada withdrew its motion seeking permission for him to attend the Senate impeachment trial of Vice President Sara Duterte after mistakenly filing it with the Sandiganbayan Second Division instead of the Fifth Division.
The anti-graft court granted the withdrawal and recalled its earlier order directing the prosecution to comment on the motion, rendering the matter moot.
Estrada’s lawyers said the motion was intended for the Fifth Division, where his non-bailable P573-million plunder case is pending, rather than the Second Division, which is handling a separate graft case.
Estrada remains detained at the New Quezon City Jail in Payatas while facing multiple charges related to alleged irregularities in Department of Public Works and Highways infrastructure and flood control projects.
The Fifth Division is the proper court to act on any request concerning his attendance at the impeachment proceedings.
