The Supreme Court of the Philippines will hold oral arguments starting April 7 on four consolidated petitions challenging the constitutionality of unprogrammed funds and special accounts in the 2024, 2025, and 2026 national budgets.
The hearings, originally planned for Baguio, will take place in Manila to cut transportation costs, with a second session scheduled on April 21.
Petitioners, including legislators, taxpayers, and civic groups, seek to nullify budget adjustments made by Congress’s Bicameral Conference Committees, citing inflated allocations and unconstitutional structures.
Among the disputed items are the P449.5 billion addition to the 2024 budget, increases in the 2025 Special Road Fund, and the P150.9 billion unprogrammed appropriations in the 2026 budget.
The Office of the Solicitor General, representing the respondents, argued that unprogrammed funds are essential for projects dependent on contingent revenues, warning that halting them would delay government programs and harm the public.
