The Department of Justice (DOJ) will follow the Supreme Court’s position on habeas corpus petitions filed by former President Rodrigo Duterte’s children before acting on any potential ICC arrest warrants for alleged co-perpetrators in the drug war.
The petitions, filed by Paolo, Sebastian, and Veronica Duterte, seek to compel the government to return Duterte from his detention in The Hague, where he faces three murder charges as an alleged “indirect co-perpetrator.”
Justice Undersecretary Polo Martinez said it is prudent to wait for the Supreme Court’s ruling before addressing any hypothetical warrants that may be issued.
The ICC document containing charges also names several former officials, including Senators Ronald “Bato” Dela Rosa and Bong Go, as part of the alleged “common plan.”
If warrants are issued, the DOJ would consider extradition, surrender to the ICC, and coordination with Interpol in handling the subjects of the arrest orders.
