The Land Transportation Office (LTO) said there is no law authorizing local government unit (LGU) traffic enforcers to confiscate drivers’ licenses, clarifying that they may only issue citation tickets.
The agency stated this after the Bacoor City government claimed its traffic enforcers could confiscate licenses under a local ordinance.
The LTO said existing Supreme Court rulings do not grant LGU enforcers general authority to seize licenses and that it is implementing a “no-confiscation” policy under a Department of Transportation memorandum.
Instead of confiscating licenses, traffic violations are digitally recorded, and motorists have 15 days to pay fines before facing possible suspension.
The LTO urged LGUs, traffic enforcers, and motorists to follow existing laws to ensure the proper enforcement of traffic regulations.
