Two agricultural groups have petitioned the Supreme Court to halt the implementation of Executive Orders 62 and 105, which adjust rice tariffs, and to declare EO 105 unconstitutional.
EO 62, signed in June 2024, lowered rice tariffs from 35% to 15%, while EO 105, signed in November 2025, sets a flexible tariff rate between 15% and 35% based on world market prices.
Petitioners argued that EO 105 was issued without the required investigations and public hearings mandated by the Customs Modernization and Tariff Act, denying due process.
They also claimed the EO gives the government legislative powers over tariff adjustments, bypassing constitutional consultation mechanisms.
The groups are seeking a temporary restraining order or status quo ante order from the Supreme Court to stop the EOs’ implementation.
