House prosecutor and Akbayan Rep. Chel Diokno clarified remarks he made during the Senate impeachment trial of Vice President Sara Duterte after Senator Pia Cayetano posted a video he said lacked context.
Diokno stressed that the prosecution’s request for Duterte’s bank records was based on probable cause and not a “fishing expedition,” citing Anti-Money Laundering Council records.
He also explained that the House could not legally access the bank records without a court order or subpoena to protect due process.
The Senate later granted the prosecution’s request to subpoena the financial records despite objections from the defense.
Diokno said the records would allow both sides to present their cases fully, enabling senator-judges to decide based on the complete evidence.
