The Office of the Ombudsman has ordered Cebu City Mayor Nestor Dionson Archival Sr. to pay a fine equivalent to one month’s basic salary over irregularities in the operation of the Colon Street Night Market last year.
The Ombudsman found him guilty of simple neglect of duty for failing to ensure compliance with operational requirements, including coordination with the Department of Public Works and Highways (DPWH) and the proper issuance of permits.
The case stemmed from a complaint alleging that more than 600 vendors were allowed to operate despite a permit covering only around 100 sellers.
However, the Ombudsman dismissed the charges of grave misconduct and gross neglect of duty due to insufficient evidence of unlawful conduct or willful refusal to perform his duties.
The decision also warned Archival that repeating the same omission could result in a more severe penalty.
