The Senate impeachment court will need 11 votes from 20 active senator-judges to overturn the ruling that set the conviction threshold at 16 votes in Vice President Sara Duterte’s impeachment trial.
An impeachment court official corrected his earlier statement that only 10 votes were needed, saying the Senate president’s vote will be counted.
The issue will be taken up on Sept. 23, with four retired Supreme Court justices expected to provide legal opinions beforehand.
The ruling could lower the conviction threshold from 16 votes among 24 senators to 13 among the 20 active members.
The case is being closely watched as the Senate prepares to resolve the contentious interpretation of the Constitution’s impeachment provision.
