A petition has been filed before the Supreme Court, urging the Senate to convene an impeachment court and immediately begin the trial of Vice President Sara Duterte, even during Congress’s recess.
Lawyer Catalino Generillo Jr. argued that the Senate has a constitutional duty to proceed with the trial promptly, as the 1987 Constitution mandates specific timelines for impeachment procedures.
The petition highlights that the Senate cannot delay the trial, as the Constitution requires immediate action once the articles of impeachment are transmitted by the House of Representatives.
While Senate President Francis Escudero stated that the trial cannot begin until after the State of the Nation Address in July, Generillo contends that the Senate’s failure to act immediately undermines the Constitution.
Duterte, who was impeached on charges of culpable violation of the Constitution and betrayal of public trust, has not commented on the petition but emphasized her legal team’s readiness for the trial.
