The Supreme Court ruled that employers must prove salary payments by showing the payroll was submitted to and received by the bank.
This decision stemmed from a case involving 49 Philippine Airlines pilots who alleged non-payment of salaries and benefits during their 1998 strike.
The Court emphasized that payroll records alone are insufficient without proof that employees received their payments.
For bank salary payments, employers must provide evidence of submitting payroll to the bank and the bank’s receipt of it.
The case was sent back to the National Labor Relations Commission to determine the exact amount owed to the former employees.
