Senate President Francis Escudero stated that the Supreme Court cannot compel Congress to pass a law banning political dynasties, citing constitutional limitations.
His remarks followed a petition by civic groups urging the SC to mandate Congress to fulfill its constitutional duty under Article II, Section 26 of the 1987 Constitution, which calls for the prohibition of political dynasties.
Escudero referenced a 2013 SC ruling that dismissed a similar petition, emphasizing that the legislative process is a political question beyond the court’s reach.
While the Constitution requires the state to ensure equal access to public service opportunities, political dynasties have remained entrenched in government.
A 2024 report found that 80% of Congressional districts are controlled by political dynasties, with several prominent families represented in the current Congress.
