Akbayan Party-list Rep. Dadah Kiram Ismula has filed House Bill No. 10099 seeking to repeal the Revised Penal Code provision that removes criminal liability for rape if the offender marries the victim or is forgiven by a spouse.
Ismula said the so-called “forgiveness clause” is outdated and undermines the dignity and rights of rape survivors.
The measure would also amend related provisions to ensure that marriage or personal pardon can no longer absolve perpetrators of sexual violence.
The bill argues that the provision allows offenders to escape accountability and may force victims to remain with their abusers.
The proposal is co-authored by Akbayan Reps. Chel Diokno, Perci Cendaña, and Dinagat Islands Rep. Kaka Bag-ao.
