Senators Robin Padilla and Bong Go, along with other petitioners, asked the Supreme Court to overturn the Senate impeachment court’s decision allowing a lower number of votes to convict Vice President Sara Duterte.
They filed a 106-page petition seeking to block the use of a reduced two-thirds vote threshold that excludes detained, suspended, absent, or incapacitated senators.
The impeachment court earlier voted 13-6-1 to allow the lower threshold, overturning the ruling that 16 votes were needed for conviction.
The petitioners argued that all 24 senators should be counted because none of the Senate seats are vacant.
They also asked the Supreme Court to prevent the impeachment court from using the lower threshold if it decides to convict Duterte.
