The Department of Labor and Employment reminded private sector employers to release the mandatory 13th-month pay to all eligible workers on or before December 24.
DOLE-BWC Director Alvin Curada said Secretary Bienvenido Laguesma has repeatedly issued the reminder since October, emphasizing that all rank-and-file employees are entitled to the benefit under the Labor Code and Presidential Decree 851.
Employees paid on piece-rate, fixed wage plus commission, those with multiple employers, and even those who resigned or were terminated must also receive the benefit, computed as no less than 1/12 of their yearly basic salary.
Curada noted that while the payment deadline is December 24, many companies release it earlier or in two installments.
Workers excluded from the coverage include those providing personal services and employees purely earning commissions.
