COMELEC TO SEEK SC CLARIFICATION ON SCRAPPED SECOND PLACER RULE

The Commission on Elections (Comelec) is considering filing a motion for reconsideration before the Supreme Court after its ruling scrapped the long-standing “second placer” doctrine in disqualification cases. 

Comelec Chairman George Garcia said the decision, which mandates that vacancies be filled through succession rather than by the runner-up, has major implications for ongoing and future electoral procedures. 

Garcia emphasized the need for clarity, particularly on whether the ruling applies retroactively and to both national and local positions, as well as its impact on cases like those of Abante and Chua. He added that Comelec will temporarily withhold rulings that may be affected, pending guidance from an en banc meeting. 

The poll body maintains that its actions are focused on preserving the integrity of the electoral process and complying with constitutional and legal standards.
