Retired Supreme Court Justice Antonio Carpio said Solicitor General Menardo Guevarra’s position is “untenable” after he refused to represent the government in habeas corpus petitions filed by the Duterte children regarding former President Rodrigo Duterte’s detention at the International Criminal Court (ICC).
Carpio argued that Guevarra should have personally recused himself instead of inhibiting the entire Office of the Solicitor General, which left the government without legal representation.
He also stated that the habeas corpus petitions are moot since the ICC has ruled that irregularities in arrest do not affect its jurisdiction.
Additionally, Carpio reiterated his support for the Philippines rejoining the ICC, citing the lack of local prosecution against Duterte.
Meanwhile, Malacañang said President Marcos has yet to discuss the issue with Guevarra.
