SUPREME COURT RULES AGAINST COMELEC’S BAN ON SMARTMATIC

The Supreme Court (SC) has ruled that the Commission on Elections (Comelec) committed grave abuse of discretion by disqualifying Smartmatic, its previous contractor, from participating in election biddings.

The SC found that Comelec disqualified Smartmatic without any reference to the eligibility requirements prescribed by its Bids and Awards Committee.

However, the SC did not nullify the contract awarded to Miru Systems, a joint venture that had already been awarded most of the major election contracts for the 2025 midterm elections.

Smartmatic welcomed the SC ruling and stated that it dealt a blow against the questionable actions of certain Comelec commissioners.

Comelec accepted the SC’s decision on their resolution against Smartmatic. The SC’s ruling allows Smartmatic to participate in future election bidding processes
