The Sandiganbayan has rejected former Quezon City Mayor Herbert “Bistek” Bautista’s motion to dismiss his graft case, stating that there is sufficient evidence against him for alleged violations of the Anti-Graft and Corrupt Practices Act.
The case revolves around a contentious P32.1 million contract with Geodata for an online permitting system.
Despite Bautista’s argument that he was not part of the bids and awards committee, the court ruled that he and former City Administrator Aldrin Cuña approved full payment for the project without complete delivery.
While the court acknowledged an appropriation ordinance for the project, issues regarding full payment remain unresolved.
Bautista’s claim of non-use due to subsequent administration decisions was noted but not determinative.
The Sandiganbayan also denied Cuña’s motion for failing to establish sound arguments.
The court stated that a full-blown trial is needed to settle the issue of criminal charges, with defense evidence presentation tentatively scheduled for March 20.
