The Supreme Court has ordered the Office of the President, Commission on Elections, and both chambers of Congress to comment within five days on a petition challenging the postponement of the 2026 barangay and Sangguniang Kabataan elections to November 2028.
Election lawyer Romulo Macalintal filed the petition seeking to block Republic Act 12326, which was signed by President Ferdinand Marcos Jr. on Sept. 24.
The law also extends the term of barangay and SK officials to five years.
Macalintal argued that the postponement violates voters’ rights and asked the SC to issue a temporary restraining order or status quo ante order.
He cited the SC’s 2022 ruling that declared a previous law postponing the BSKE unconstitutional.
