Lawyer Hazel Meking has filed a petition with the Supreme Court challenging the Department of Justice’s new evidence standard in criminal cases, outlined in Department Circular 15.
The circular raises the proof requirement from “probable cause” to “prima facie evidence with reasonable certainty of conviction,” which Meking argues makes it too difficult for victims to seek justice early in the process.
She pointed out that determining certainty of conviction at the investigation stage is premature due to the lack of evidence and trial.
Meking also noted inconsistent implementation of the circular by prosecutors nationwide, leading to complaints being dismissed before reaching the courts.
The DOJ defends the new standard, citing an increase in the conviction rate to 78% since applying stricter rules under Circular 20.
