Election lawyer Romulo Macalintal has asked the Supreme Court to declare unconstitutional the law postponing the November 2026 Barangay and Sangguniang Kabataan Elections to November 2028.
Macalintal filed a petition challenging Republic Act 12326 and also sought a status quo ante order, temporary restraining order, and preliminary injunction to stop its implementation.
He argued that the repeated postponements infringe on voters’ right to suffrage, noting that the elections were originally scheduled for December 2025 before being moved to November 2026 and eventually to November 2028.
Macalintal also questioned the law’s holdover provision, arguing that treating the extended tenure of incumbent barangay officials as a completed term could conflict with the constitutional requirement that barangay officials be elected.
The Supreme Court petition names the Office of the President, Senate, House of Representatives, and Commission on Elections as respondents and asks the court to review the constitutionality of the election postponement.
