Senator Robinhood Padilla has filed a bill to lower the minimum age of criminal responsibility from 15 to 10 years old.
The proposed measure seeks to amend the Juvenile Justice and Welfare Act to remove exemptions for minors aged 10 to 17 who commit heinous crimes, such as murder, kidnapping, and rape.
Under the bill, children aged 10 to 18 involved in heinous offenses would be held criminally liable and would not qualify for community-based interventions or automatic case dismissals.
Non-heinous offenders aged 15 and below would still be subject to restorative programs rather than punitive measures.
Padilla emphasized the need to balance restorative justice for youth offenders while maintaining the integrity of the justice system against serious crimes.
