The Sandiganbayan’s Second Division has dismissed a civil case against the Marcos family, citing a violation of their right to a speedy case disposition.
In a 30-page resolution released on October 4, 2024, the court granted the motion to dismiss filed by former First Lady Imelda Marcos and the heirs of the late President Ferdinand E. Marcos, noting that delays were caused by issues such as a defective complaint and the absence of pre-trial proceedings over more than 30 years.
The court expressed concern that the prolonged timeline has compromised the defendant’s ability to secure a fair trial, as key witnesses may have died and evidence could be lost.
Additionally, the plaintiff, the Republic represented by the Presidential Commission on Good Government, did not oppose the motion to dismiss, indicating an agreement with the court’s conclusion that there were no valid allegations against the Marcos estate.
The ruling reinforces the constitutional right to a speedy disposition of cases as stipulated in the 1987 Constitution.
