Former Senate President and Presidential Legal Counsel Juan Ponce Enrile said amending the 1987 Constitution may be needed to avoid confusion in future impeachment trials.
He cited the current delay in Vice President Sara Duterte’s impeachment as an example, caused by questions about which Senate members should handle the trial.
Enrile pointed out that the 1935 Constitution’s provision for a two-thirds Senate quorum ensured continuity, unlike the 1987 Constitution’s one-half quorum rule.
He suggested that either the Supreme Court should clarify the rules or the Constitution should be amended to restore the two-thirds quorum.
Despite the ongoing delay, Enrile believes the impeachment trial can still proceed.
